Terms of Service

Introduction
These General Terms of Service (“Terms”) govern your use of all digital products and services (“Services”) provided by Xelens Technologies d.o.o, including but not limited to:
- The Xelens iPad application for optical retail stores,
- Any associated web portals, dashboards, or integrations,
- Any APIs, technical support tools, or measurement systems delivered as part of the digital service suite.
By using any of our Services, you agree to these Terms.
Definitions
- “Xelens Technologies” or “Xelens” refers to Xelens Technologies d.o.o, the company that owns and operates the Services provided under these Terms of Service.
- “Client” refers to the optical retail business or professional entity licensed to use Xelens Services.
- “End User” refers to the individual (e.g., a customer in an optical store) whose data may be processed via the Services.
- “You” refers to the Client or authorized personnel using the Services.
Scope of Use
Xelens grants you a non-exclusive, non-transferable license to use the Services within your organization, strictly for internal business use. You may not copy, sublicense, modify, reverse engineer, or commercially redistribute the Services unless explicitly authorized.
Intellectual Property
All content, algorithms, models, measurement logic, interface designs, documentation, and related materials remain the exclusive property of Xelens Technologies d.o.o. Clients may not claim ownership or derive competing products from the Services.
Data Protection & Privacy
Xelens Technologies does not collect or store any personal data through the Services. All data is stored locally on the Client’s or End User’s device, and the Client retains control of all data. Xelens does not access, process, or store personal data remotely. The Client is responsible for ensuring that any data they store or process via the Services complies with applicable privacy laws and regulations, including obtaining any necessary consents for the collection and use of data. Support and Service Levels
Technical support is available to Clients during business hours, as defined in your separate Service Agreement or contract. Updates and upgrades to the Services may be delivered automatically.
Third-Party Services
If the Services integrate with third-party services (e.g., cloud storage, device features), you are subject to those services’ respective terms and policies. Xelens is not liable for their behavior.
Limitations of Liability
Xelens Technologies is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use the Services. Liability is limited to the maximum extent permitted by applicable law and to the amount paid under the specific service agreement.
Termination
Xelens may suspend or terminate your access to Services if these Terms are violated or if your license agreement expires or is breached.
Modifications
We may update these Terms from time to time. You will be notified via email or in-app prompt. Continued use after updates implies acceptance.
Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Serbia, without regard to conflict of law provisions.
